Emergency Declarations and Waivers Relating to Hurricane Harvey

In the wake of Hurricane Harvey, Michigan’s State police announced there have been many emergency declarations and waivers issued.

Emergency declarations in accordance with 49 CFR 390.23, exempt motor carriers from Parts 390-399 of the Federal Motor Carrier Safety Regulations.

Many states have also issued emergency waivers from size, weight, registration, and/or fuel tax requirements for response to recovery efforts. These waivers vary from state-to-state and are only valid in the state that issued the waiver.

Motor carriers operating on any of the emergency declarations or waivers should have a copy of the declaration or waiver in the commercial motor vehicle.
